IF YOU HAVE NOT READ AND UNDERSTAND THESE TERMS, PLEASE DO NOT BID. BY BIDDING ON THIS AUCTION, YOU ACKNOWLEDGE THAT YOU AGREE TO ALL TERMS AND CONDITIONS SET FORTH AND HAVE ENTERED INTO A LEGALLY BINDING CONTRACTUAL AGREEMENT TO PURCHASE THE ITEM(S) UNDER THE FOLLOWING TERMS AND CONDITIONS:


REGISTRATION: All bidders are required to register and must provide their name, address, daytime phone number, email address and credit card. Registration may only be completed with an acknowledgment that the bidder has read and understood all terms and conditions for the auction and online bidding. T&S Auction Service LLP reserves the right to remove any bidder if there is any question as to their credentials or ability to enter into a legally binding contract. Bidders agree to keep their user name and password confidential as they are responsible for any and all activity involving their account. Violations will result in termination of bidder's ability to participate in future auctions conducted by T&S Auction Service LLP.

CATALOG: T&S Auction Service LLP makes every effort to provide accurate photos & descriptions of all auction items listed; however, all items are sold as-is. Bidders are encouraged to attend the scheduled preview as it is each bidder's responsibility to make their own determinations as to the exact condition of each item. Although we provide images of each item, descriptions of auction items, as provided by T&S Auction Service LLP, are only our opinion and should not be the sole basis for your bidding decisions. We do not use "stock" photographs or use one photo to represent multiple lots. T&S Auction Service LLP Reserves the right to change/alter descriptions as needed to better describe and preserve accuracy.

BIDDING: By bidding on any item, the bidder shows acceptance of the terms of the auction. When bidding on items, it is your responsibility to know and abide by any and all local, state and federal laws.

All assets are being sold in "As-Is, Where-Is" condition and with all faults, imperfections and errors of description. Neither the Seller nor Auctioneer makes any warranty, express or implied, as to the nature, quality, value or condition of any asset. Auctioneer and Seller expressly disclaim any warranty of merchantability or fitness for a particular use. No sale shall be invalidated by reason of any defect or inaccuracy in any description or listing, and no liability shall be borne by the Auctioneer with respect to such errors. All information has been obtained from sources generally believed to be reliable, but the accuracy cannot be guaranteed or warranted by the Auctioneer. Bidder acknowledges it is their responsibility to inspect all assets and to make their own inquires.

You are encouraged to use the Max Bid feature and not bid "at the last second".

The bidding will begin to close at the designated date and time. For your convenience, the closing of items will be on a staggered basis of 1 item every 12 seconds. 

All of our online auctions feature a soft close. If a bid on any item is received within two (2) minutes of close, that item will automatically extend for two (2) minutes. Each time there is bidding activity within the last two (2) minutes of the item close, bidding will continue to extend two (2) minutes until there is no bidding activity within the last two (2) minutes of the current close time. 

Online bidding is to be understood as a binding contract. Bids are taken with the understanding that the bidder will honor their winning bid with sufficient funds including all applicable taxes and fees. Do not bid if you do not intend to pick up or arrange for your items to be shipped.

TECHNICAL ISSUES: Please note that all online auction systems are subject to various internet speeds. Again, you are encouraged to use the Max Bid feature and not wait to bid "at the last second". Enter your bids promptly, to allow the online system to process all bids in a timely fashion. In the event there are technical difficulties related to the server, software, internet or any other online auction-related technologies, T&S Auction Service LLP reserves the right to extend, continue or close the bidding. Neither T&S Auction Service LLP, nor the software provider, shall be held responsible for the failure of the software to function properly for any reason.

Disputes: The Auctioneer will be the final judge as to who is the successful bidder. In the event of any dispute, the Auctioneer shall, at his discretion, decide whether or not to reopen the bidding.

Title to Goods: Title to all merchandise shall pass to the successful bidder at the fall of the Auctioneer's "hammer". The purchaser shall assume full responsibility for the lot purchased once title has passed.

Removal of Goods: Bidders are responsible for their own removal. Any item NOT picked up by the set time will be considered abandoned back to the Seller. No refunds or charge backs will be granted due to lack of removal at designated times. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will only be released following full payment. Please insure that movers or anyone picking up items on your behalf have your paid receipt at the pickup location. No items will be released without a paid email receipt

Shipping: Shipping is not offered on all auctions. When shipping is offered, it may not be offered on all items. See item detail for shipping availability. 

If shipping is not available, items must be picked up on the allotted pick up day(s).

Invoicing: We will email your invoice within 2 hrs of the auction ending. If, after that time, you do not see your invoice in your In Box, please check your Spam or Junk folder.

You may also receive a text message and email from Shipping Saint to select pick up time (when scheduling is used) or shipping (when offered). It may take up to 7 business days to ship for large auctions. You will be billed separately for shipping when your items are packed & weighed.  All shipping fees must be paid directly through the Shipping Saint link. You will receive this link through text and email. Shipping will be via USPS, FedEx or UPS. When shipping invoice is paid shipping will be finalized and you will receive tracking number once your label is printed.

Payment Terms: Full payment from the winning bidder in the amount of the auction closing price, applicable Buyer's Premiums and sales tax must be made at pick up or prior to shipping, when offered. Buyers may pay for their Items online with a valid credit card, with cash or credit card at the time of pick up or, at times, we may require payment via wire transfer. Without limiting the foregoing, full payment is due prior to the removal or transportation of purchased Items. 

Sales Tax: Pursuant to the laws of the State of Indiana, all sales, including buyer's premiums, are subject to the collection of a 7% sales tax. For online bidders, we must charge sales tax if the buyer lives in Indiana or picks up in Indiana. You may present a valid resale license and complete the necessary Indiana certificate for Sales Tax Exemption. Lots shipped out of state are not subject to IN state sales tax.

Buyer's Premium: There will be a buyer premium added to the sale of the successful high bid if bidding on an online auction. This is regardless of payment method. All bidding at auction and all purchases will be in U.S. Dollars.

Payment: Payment due before removal of items, by Cash or Credit Card. We may, at times, require payment via wire transfer.

Errors: T&S Auction Service, LLP is not responsible for any typographical or any other error or omission in this catalogue or subsequent price key. T&S Auction Service, LLP reserves the right to withdraw any property before the sale.

Preview: Prior to most auctions we have a preview of the items in the catalog. Our staff is present to answer questions about items and to offer help with the auction process. 

Absentee / Internet Bidding: As a service to our customers, T&S Auction Service, LLP will execute absentee bids if so authorized in writing under the provisions herein specified. Absentee bids should be made on the Absentee Bid Form provided in each catalogue. This form should be clearly and completely filled out and accompanied by a valid credit card. All absentee bids will be executed competitively during the sale; items will be purchased for the lowest price possible.  T&S Auction Service, LLP cannot accept "buy" bids. In the event of tie bids between absentee bidders and those in attendance, preference will be given to the attending bidder. When two absentee bidders bid on the same amount, the first received will be honored. Successful buyers will be notified within three (3) days of the sale. This service is offered as a convenience and T&S Auction Service, LLP will not be responsible for any errors or failures to properly execute absentee bids. Absentee bids will not be guaranteed unless received prior to the day of the sale. All associates with T&S Auction Service, LLP reserve the right to bid on and buy any items up for auction.

Agreement to Terms: In bidding on any lot here offered, the bidder indicates acceptance of these Terms and Conditions of Sale. The title of each lot passes when the auctioneer says, "Sold". Thereafter, any loss by fire, theft, breakage, or any other cause is the sole responsibility of the purchaser. Merchandise must be packed and transported by the purchaser at his own risk and expense. If any employee or agent of T&S Auction Service, LLP shall pack or transport the merchandise, it is fully at the risk, responsibility and expense of the purchaser and T&S Auction Service, LLP shall not be liable for any loss or damage that may be caused by such employee or agent.

Bidder Responsibility: The bidder is responsible for knowing on which item(s) he or she is bidding. If unsure, the bidder should inquire, or not bid. When becoming the winning bidder at auction, you have affected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor "mistakes". Should the bidder end up with an item he or she did not intend to purchase, that bidder may resell it directly to another person at the end of the auction. Do not concern the auctioneer with this, as no sales will be voided, and no items will be offered for resale. Also, please note that all items and contents in any furniture or articles sold are reserved unless otherwise announced. This includes items in drawers and other areas undiscovered by our presale workers.

Acceptance of Bids: The Auctioneer reserves the right to accept or reject bids in any increment which the auctioneer deems to be in the best interest of the client, the seller.

Check Out - Payment in full is due at the conclusion of the sale or upon leaving the auction. If a checkout area is set up, no items can be removed until full payment has been made.

Announcements: All announcements made day of sale will take precedence over any printed matter. Firearms - Know your State/Federal firearms laws BEFORE bidding.  We are NOT a licensed FFL Dealer. All federal and state firearm laws govern every aspect of this auction, and any infraction of the law will immediately be reported to local law enforcement and the ATF.  You must be 18 to purchase rifles or shotguns and 21 to purchase a handgun.  There is no inspection period for your purchase, ALL GUN SALES ARE FINAL.  You are responsible for knowing if your state bans a certain type of firearm/ammo/accessory from being shipped to you.  

The Auctioneer reserves the right to add or remove items from the auction - split or combine lots - add minimum bids or reserve prices- bid on behalf of the seller to meet reserves - cancel, suspend, extend or reschedule an individual item and or auction event - make changes to the auction closing times or inspection or removal times. Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled in Washington County, Indiana. Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.

The above-stated Terms & Conditions of Sale cannot be altered except in writing by the Auctioneer.
